Please note that the house is not suitable for children under the age of 6. The lessee is required to pay 100% of the total rental amount including the breakages deposit on reservation in order to secure the booking. The Owner has the right to release the booking should the indicated amount not have been received within five working days from date of this agreement. Payments are to be made by internet transfer or bank transfer. The lease agreement in terms of which the premises are let to the lessee is between the lessee and the Owner.. The lease agreement comes into effect and will be binding on the lessee and the Owner on receipt by the Owner of a copy of a confirmation of reservation signed by the lessee. The owner shall inspect the premises within 48 hours after the lessee has vacated and the breakages deposit will be refunded to the lessee after any deduction of the cost of repairing any damage to the premises and/or to the contents thereof and any other expense for which the lessee is liable. The lessee hereby authorises the Owner to utilise such funds as may be necessary from the aforesaid deposit. The security deposit may not be used for the rent, or any part thereof at any time, for any reason whatsoever. The Lessee shall provide the Owner with a list of defects found on the premises, in writing, within 24 hours of occupation. The Lessee shall keep the premises and contents in good order and, at the termination of the lease period, will return the premises and the contents in good order and condition as they were at the commencement of the lease. The lessee will be liable for the cost of repairing any damage or repairs or deterioration to the premises or the contents during their tenancy. The premises shall be used only as a private residence. No functions, no castings, stills or films shoots allowed, unless by prior arrangement. The Lessee shall not have the right to assign or sublet the premises or any portion thereof without the consent of the Owner. The Lessee undertakes not to cause a nuisance to any other tenants or occupiers of adjacent properties of which the premises form part of or in the vicinity of the leased premises by and means whatsoever especially noise which may cause a nuisance. The Lessee hereby agrees to abide by the house rules of the property or of the Body Corporate. The Owner shall have the right of access in order to affect any repairs to the premises. The Lessee shall not have any right to claim damages or withhold any monies otherwise due to the Owner on account of an alleged breach of this lease, any act or omission by ProProperty or its agents, the condition of any let premises provided they are suitable for beneficial occupation by the lessee, the failure or suspension of electricity, water or any other amenity or any other equipment or machinery on the premises, any interruption or disturbance not attributed to ProProperty wilful misconduct. The terms of this document form the sole contractual relationship between the parties hereto and no warranty or representation express or implied or variation of this lease shall effect the terms hereof unless such warranty or representation shall be reduced to writing and signed by the parties hereto. The Owner accept no liability in respect of any theft, loss, damage or injury to the person or property of the lessee, his or her family, occupants or visitors arising from fire, theft, accident, intrusion or otherwise by whomsoever caused, or arising from the negligent or wrongful act of any person in the employment of the owner, or any other cause. The Lessee consents to the jurisdiction of the Magistrate’s Court, Cape Town, for the purpose of any action, which may be instituted against the lessee. The Lessee will be liable for legal cost on the attorney and own client scale and also for all collection commission levied in the event of the lessee being in default in respect of the lessee’s obligations in terms hereof.
