Beach: Located within walking distance from the beach, with fantastic ocean views.
Duration: The duration of the Tenant’s occupation of the Premises will be as indicated above, both dates inclusive.
Number of occupants: The Tenant undertakes that the maximum number of persons staying on the premises will not exceed the number stated on the rental agreement, unless the owner has given prior written permission.
Confirmation of booking: To confirm the provisional reservation, the Tenant must ensure that Knight Frank receives the deposit, referred to above, within 48 hours of signing and returning a duly completed and signed copy of this agreement.
The balance of the total amount owing in respect of the reservation shall be settled at least 60 days prior to the arrival of the Tenant.
Cancellation: In the event of cancellation of the confirmed reservation more than 60 days prior to the agreed date of arrival, Knight Frank reserves the right to retain 50% of the deposit.
In the event of cancellation of the confirmed reservation less than 60 days prior to the agreed date of arrival, Knight Frank reserves the right to retain 50% of full amount of the rental cost.
Travel Insurance: It is a condition of this agreement that every person included in the booking must have valid travel insurance in place for the entire duration of the Tenant’s occupation of the Premises. Such insurance should cover medical and personal liability, liability for loss of luggage, monies and repatriation liability for cancellations for whatever reason where any cancellation is outside the time period as set out in this agreement.
Check in and check out: Check in time is 14h00 and check out time is 10h00. The Tenant agrees to adhere to these times. An earlier arrival or later departure can be guaranteed at an additional cost of a half day’s rental per occurance.
Damage Deposit: The Tenant will pay R105-00 per day for insurance cover in the form of a Breakage Guarantee to be issued byGuardrisk Insurance Company. The Tenant is required to sign the
required documentation to ensure that the Breakage Guarantee is issued before
access will be granted to the Premises.
The Tenant will be liable to pay to Knight Frank or the Owner, immediately upon demand for any damage caused by the Tenant and/or his party if the damage caused exceeds the Guaranteed Amount or if the loss/damage suffered is not covered by the Breakage Guarantee. The GEXSA amount is incorportated into the quoted daily rate.
Authority: The Tenant who makes a booking thereby warrants his/her authority on behalf of all persons included in the booking to agree that all such persons shall be bound by the terms and conditions of this rental agreement.
Use of premises: The Tenant shall not do anything or permit anything to be done in or on the Premises which is illegal and/or may become a nuisance or annoyance to or in any way interfere with the comfort of neighbours.
The Tenant shall use the Premises only for residential accommodation and any commercial activity must be expressly authorized prior to occupation. If any unauthorized commercial activity occurs, the rental rate for the period will be double (2 times) the agreed rate.
No parties, special events or functions are permitted on the premises unless prior written consent has been given by the owner.
Defects: The Tenant shall notify Knight Frank within 24 hours after the date of arrival of any defects in the Premises. If the Tenant has not notified Knight Frank as aforesaid, he shall be deemed to have acknowledged that the Premises were received in good order and condition.
Should the Tenant find any defect in the Premises, Knight Frank will have, within reason, 48 hours from the client’s notification to attend to the defect.
Good order: The Tenant shall keep the Premises and its contents in good order and condition as it were on the date of arrival and shall return the Premises and the contents in the same good order and condition on the date of departure and all costs incurred in repairing any damage to the Premises or the contents thereof, whether caused by the Guests or their visitors and whether accidental or intentional, shall be borne by the Tenant.
All villas are booked by the Tenant as per the description and details presented to the Tenant by the Villa and/or the Premises page on the Knight Frank website. Knight Frank cannot be held responsible should the Tenant or any guest be unhappy with his/their choice of premises.
The Tenant shall use his/her best endeavours to keep the pool, garden, yard and grounds in good order and condition.
The Tenant shall keep the Premises in a clean, tidy and sanitary condition.
The Tenant shall not cede any of their rights or delegate any of their obligations under this agreement.
A strict no smoking clause applies to the Villa.
The Tenant must ensure that children are supervised at ALL times.
The Tenant acknowledges that he/she is required and obliged to set the alarm and lock the premises on each and every exit from the Premises.
Sub-letting: The Tenant shall not sub-let, permit anyone else to occupy the premises nor part with possession of the Premises or any part thereof.
Loss and damage: The Tenant shall not have any claims of any nature against Knight Frank or the owner for any loss, damage or injury which the Tenant may directly or indirectly suffer (even if such loss, damage or injury is caused through the negligence of Knight Frank or Knight Frank house keeper or employees or the owner), by reason of any latent or patent defects in the Premises, fire in the Premises, theft from the Premises, by reason of the Premises or any part thereof being in a defective condition or state of disrepair or any particular repair not being effected by Knight Frank or the owner timeously or at all, arising out of any defect in the water, gas or electricity supply to the Premises, arising out of vis major or any other cause either wholly or partly beyond Knight Frank’s control or the control of the owner or arising from any other cause whatsoever.
Pets: The Tenant shall not be entitled to keep or to bring onto the Premises any pets without the prior written consent of Knight Frank.
Special Needs: The Tenant undertakes to inform Knight Frank or the owner if they or any of their party has difficulties with stairs, using conventional showers and baths or if they have any particular allergy or other medical or mobility issue.
Keys: The Tenant shall not be entitled to make any duplicates of any keys in respect of the Premises without the prior written consent of Knight Frank and shall, upon departure, forthwith deliver all keys (including remote controls) to Knight Frank or its appointed agent.
Access: Knight Frank shall at any time have reasonable access to the Premises for the purpose of inspecting the Premises or for showing prospective tenants or purchasers the Premises or for any other reasonable purpose provided that Knight Frank shall exercise its rights in terms hereof with the least possible inconvenience to the Tenant.
Claims: The Tenant undertakes to pay to Knight Frank or the owner an amount equal to any claim made against Knight Frank or the owners by anyone for any loss, damage or injury suffered in or on the Premises in consequence of any act or omission by any Tenant or any persons under the Tenants’ control.
Jurisdiction: In terms of Section 45 of the Magistrate’s Court Act 1944, as amended, the Tenant consents to the jurisdiction of the Magistrate’s Court having jurisdiction of the Tenant’s person in respect of any action or proceedings which may be instituted against the Tenant in terms of or arising out of this agreement notwithstanding the amount of the relevant claim. Notwithstanding the aforegoing Knight Frank will be entitled, in its discretion, to institute any action or proceeding against the Tenant in terms of or arising out of this agreement at any High Court which has jurisdiction. The Tenant agrees to the exclusive jurisdiction of the Magistrates Court of Cape Town in filing any action against Knight Frank or the owner.
Should the Tenant:
1. fail to pay any amount due in terms of this agreement on due date; or
2. commit or allow the commission of any other breach of this agreement and fail to remedy that breach within a period of 7 (seven) days after the receipt of notice to that effect by Knight Frank; or
3. repeatedly breach any of the terms of this agreement in such a manner as to justify Knight Frank in holding that the Tenant’s conduct is inconsistent with the intention or ability of the Tenant to carry out the terms of this agreement,
then and in any of such events Knight Frank shall without prejudice to its right to claim damages or to any other claim of any nature whatever that Knight Frank may have against the Tenant as a result thereof:
4. be entitled to cancel this agreement; or
5. be entitled to remedy such breach and immediately recover the total cost incurred by Knight Frank in so doing from the Tenant.
Should Knight Frank institute action against the Tenant pursuant to a breach by the Tenant of this agreement, then without prejudice to any other rights which Knight Frank may have, Knight Frank shall be entitled to recover all legal costs incurred by it including attorney and own client charges, tracing fees and such collection commission as Knight Frank is obliged to pay to its attorneys from the Tenant.
The validity, interpretation and performance of this agreement will be governed by the law of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the courts of the Republic of South Africa in respect of any dispute that arises in connection with this agreement or resulting from any injuries or other damages or losses occurring during the lease period.
No alteration, cancellation, variation of or addition hereto shall be of any force or effect unless reduced to writing and signed by all parties to this agreement or their duly authorised representatives.
This agreement cancels and super cedes the terms and conditions of all prior negotiations and agreements between the parties.
This document contains the entire agreement between the parties and no party shall be bound by any undertakings, presentations, warranties, promises or the like not recorded herein.
No indulgence, leniency or extension of time which Knight Frank may show to the Tenant shall in any way prejudice Knight Frank or preclude Knight Frank from exercising any of its rights in the future.
